1. Acceptance of Terms
By using BSG Aviation’s website, requesting information, requesting a quote, or engaging BSG Aviation for any service, you agree to be bound by these Terms & Conditions. These terms govern your use of our services and form a legally binding agreement between you (the client, operator or passenger) and BSG Aviation.
2. Our Services
BSG Aviation offers aviation support services including, but not limited to: ground handling, flight planning, fueling arrangements, FBO services, flight catering, meet & assist services, visa assistance, permit handling (overfly & landing), hotels and VIP vehicles, and related support. Service availability depends on airport permissions, local regulations and third-party partner capacity.
3. Quotes, Bookings & Confirmation
All quotes provided by BSG Aviation are indicative and valid for the period specified in the quote. A booking is considered confirmed only after written acceptance of the quote and receipt of any required deposit or payment as specified in the quote or invoice. We reserve the right to decline or cancel any booking where permits, slots, or regulatory approvals cannot be obtained.
4. Pricing & Payment
Prices for our services are quoted in the currency stated on the quote or invoice. Unless otherwise agreed in writing, all invoices are payable within the payment terms specified on the invoice. Late payments may incur interest charges and/or suspension of services. For recurring or corporate clients, credit facilities may be offered subject to a separate credit agreement.
5. Cancellations & Changes
Cancellations, reductions or changes to confirmed services must be sent in writing. Cancellation fees may apply as specified in the quote. For last-minute cancellations or changes (including no-shows), BSG Aviation may charge the full cost of the confirmed services and any non-recoverable third-party fees.
6. Permits, Clearances & Client Responsibilities
Clients are responsible for providing accurate and timely flight, passenger, and crew documentation. BSG Aviation will assist in obtaining necessary permits and clearances where agreed, but cannot guarantee approval. Any incorrect, missing or delayed documents provided by the client that result in additional costs or delays will be charged to the client.
7. Third-Party Suppliers
BSG Aviation may subcontract services to third-party suppliers (e.g., fuel vendors, caterers, ground handlers, hotels). While we select reputable partners, BSG Aviation is not responsible for the acts, omissions, performance or failure of third-party suppliers except where we have been negligent in selecting partners.
8. Liability & Limitation of Liability
BSG Aviation will exercise reasonable skill and care in the performance of its services. To the maximum extent permitted by applicable law, BSG Aviation’s liability for any loss, damage or expense arising from its negligence or breach is limited to the total fees paid by the client for the relevant service. BSG Aviation shall not be liable for indirect, incidental, consequential or special damages including loss of profits, loss of business or reputational loss.
9. Force Majeure
BSG Aviation will not be liable for any delay or failure to perform resulting from circumstanceBSGeyond its reasonable control (including but not limited to: acts of God, strikes, government action, pandemic-related restrictions, airport closures, natural disasters, air traffic control restrictions, security incidents or delays in obtaining permits). Where a force majeure event occurs, BSG Aviation may suspend or reschedule services and will notify clients as soon as practicable.
10. Data Protection & Confidentiality
BSG Aviation will process personal data in accordance with applicable data protection laws and our Privacy Policy. Personal and flight information provided to us will be used only for the purpose of delivering the agreed services and for regulatory compliance. Both parties will keep confidential any non-public information exchanged in connection with services, except where disclosure is required by law or regulatory authority.
11. Intellectual Property
All content, designs, text, images, logos and trademarks on the BSG Aviation website and in our documentation remain the intellectual property of BSG Aviation or our licensors. The client is granted a limited right to use such materials solely for the purpose of the agreed services.
12. Insurance
Clients are responsible for maintaining all necessary insurance (including hull & liability insurance for aircraft and public liability insurance) as required by law or standard industry practice. BSG Aviation maintains professional liability and related insurance for its operations; however, clients must ensure appropriate coverage for their own risks.
13. Complaints & Dispute Resolution
Any complaint should be raised promptly with BSG Aviation via the contact detailBSGelow. We aim to resolve complaints quickly and fairly. If a dispute cannot be resolved amicably, the parties agree to enter into mediation before commencing formal legal proceedings.
14. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India, unless otherwise agreed in writing.
15. Amendments
BSG Aviation reserves the right to update or amend these Terms & Conditions at any time. Revised terms will be posted on the website with an updated “Last updated” date. Continued use of our services after publication of changes constitutes acceptance of the updated Terms.
